These terms and conditions (“Agreement”) set forth the general terms and conditions of your use of the cumberlandbeach.com website (“Website” or “Service”) and any of its related communications or community rosters (collectively, “Services”). This Agreement is legally binding between you (“User”, “Member”, “you” or “your”) and Cumberland Beach & District Ratepayers Association Inc. (“the Association”, “we”, “us” or “our”).

By accessing and using the Website and its Services, you acknowledge that you have read, understood, and agree to be bound by the terms of this contract. If you do not agree to abide by these terms, you are not authorized to use the Website.

1. Membership Eligibility and Boundaries

The Association is a localized, non-profit neighborhood group. Digital registration and dues submission are strictly intended for residents, property owners, and individuals within the designated geographic boundary of the Cumberland Beach district. By applying for membership or submitting payments through the Website, you represent that you meet the residency or property requirements set out by the Association’s bylaws.

2. Dues, Payments, and Refusal of Service

All membership dues, donations, or community contributions processed through the Website are utilized to fund local administration, neighborhood advocacy, and the maintenance of shared community assets. The Board of Directors reserves the right to review, audit, and refund any digital dues transaction if an applicant is found to reside outside the structural boundaries or fails to meet eligibility requirements under our corporate bylaws. No contractual or property right is created solely by processing an automated payment online.

3. Physical Asset & Community Park Boundaries

The Association owns physical real estate, specifically a private community park on Lake Couchiching. Nothing within this digital Agreement grants automatic, unregulated entry or use rights to that physical property. Use of the community park is strictly limited to paid members in good standing and is governed entirely by separate, physical park bylaws and safety regulations. The Association explicitly states that violating physical park rules or causing disruptions on-premises can result in the immediate revocation of your Association membership.

4. Prohibited Digital Uses

In addition to other terms as set forth in the Agreement, you are prohibited from using the Website, its forums, or its content:

(a) for any unlawful, fraudulent, or unauthorized purpose;

(b) to violate any international, federal, provincial, or local municipal ordinances and bylaws;

(c) to transmit automated spam, viruses, or malicious code;

(d) to impersonate another resident or board member.

We reserve the right to terminate or block your access to the digital platform for violating any of these parameters.

5. Intellectual Property Rights

This Agreement does not transfer to you any intellectual property owned by the Association or third parties. All rights, titles, and interests in the website design, local history archives, photography, and original newsletters remain solely with the Association or their respective contributors.

6. Disclaimer of Warranty

You agree that your use of the Website and its informational resources is entirely at your own risk. The Service is provided on an “as is” and “as available” basis. We expressly disclaim all warranties of any kind, whether express or implied. We make no warranty that our digital services will be completely uninterrupted, secure, or free from typographical errors, nor do we guarantee that historical neighborhood summaries are completely error-free.

7. Limitation of Liability

To the fullest extent permitted by applicable law, in no event will the Association, its elected Board of Directors, officers, volunteers, or committee members be liable to any person for any indirect, incidental, special, punitive, or consequential damages arising out of your navigation of this website.

To the maximum extent permitted by law, the aggregate liability of the Association relating directly to website usage or electronic communication will be limited strictly to an amount no greater than the total annual membership dues actually paid by you to the Association during the current calendar year.

8. Indemnification

You agree to indemnify and hold the Association and its directors, officers, and volunteers harmless from and against any third-party claims, liabilities, losses, damages, or costs (including reasonable legal fees) incurred as a result of or relating to your misuse of the Website, your violation of these digital terms, or any willful misconduct on your part.

9. Severability

If any provision of this Agreement is held to be illegal, invalid, or unenforceable by a court of competent jurisdiction, the remaining provisions or portions thereof shall remain in full force and effect.

10. Dispute Resolution

The formation, interpretation, and performance of this Agreement, along with any digital administrative disputes arising out of it, shall be governed strictly by the laws of Ontario and the federal laws of Canada applicable therein. You hereby submit to the exclusive personal jurisdiction of the courts located in Ontario, Canada.

11. Changes and Amendments

 We reserve the right to modify this Agreement at any time at our discretion. When updates occur, we will revise the updated timestamp at the top of this document. Your continued use of the Website after that point will constitute clear consent to those structural modifications.

12. Acceptance of These Terms

By navigating cumberlandbeach.com, submitting forms, or digitally paying your neighborhood membership dues, you acknowledge that you have read this contract and agree to be bound by its terms.
